First things first, make sure all potential attorneys specialise in family law and have experience in the specific type of divorce you think is best for you.

  1. Collaborative Divorce: Each spouse will hire their own attorney and the four parties will meet to solve the terms of the divorce.
  2. Mediated Divorce: Spouses will hire one mediator to facilitate communication between the two spouses.
  3. No-Fault Divorce: This type of divorce could be seen as the most amicable, as it suggests no fault by either spouse apart from a breakdown of the marriage.
  4. Summary Divorce: This is a streamlined process for short marriages with limited property, no spousal support, and no children.
  5. Uncontested Divorce: Spouses are able to agree on the terms of the divorce, without lawyers or a court proceeding.

You can start your research and interview process with an initial phone call to a candidate you deem suitable.

Things to ask:

  • What is your experience and specialisation within family law?
  • What type of client do you typically represent?
  • What are your rates? (Most divorce lawyers charge an hourly fee and require a retainer. Some lawyers may negotiate if the settlement contested is significant. Do not waste your time meeting with a lawyer that is out if your cost range.)
