7 Points to Remember When Drafting a Divorce Order

Following Brad and Angelina's untimely announcement of their divorce, we decided to take a look into the current divorce statistics in SA.

Divorce Statistics in South Africa

When looking at the current marital landscape in South Africa, it was clear that a trend had developed. The latest report from Stats SA (2014) reveals that less people are getting married and more are getting divorced. In 2014, 150 852 people wed in civil marriages, 3 062 had customary marriages and 1 144 were married in civil unions. Within the same year, 24 689 people got divorced. 3,4% higher than the previous year, and mainly initiated by the female partner. In addition, 51,7% of divorces were initiated by wives, while 34,4% were initiated by husbands, and about 58% of the wives that initiated divorces were white. Of the 24 689 divorcees, the black African population makes up the highest portion, at 37,1%. The white population make up 28,2% and 20,2% for the coloured population.
“Couples from the white population group dominated the number of divorces from 2003 to 2007. Thereafter, black African couples had the highest number of divorces up until 2014. In 2003, 40% of divorcees were within the white population group, whereas 24,3% came from the black African population group.”
The report goes on to say that most of the couples that divorced had been married for about five to nine years, and that the average age of divorce was 43 for men and about 40 for women. Most people whose marriages ended in divorce had children under the age of 18. legal_article_banner

Who is Initiating the Divorce?

The men who initiated the divorce were largely managers and administrators (14,5%). While the women were mainly in professional, semi-professional and technical occupations (14,3%). The report shows that 80% of divorces initiated from either men or women were first-time marriages. About 12,4% of men and 10,9% of women who initiated divorce were married for the second time, and about 2% of both men and women got divorced for the third time. While the registration of civil marriages dropped by 4,9% and customary marriages by 12,5%, civil unions increased by a whopping 15,2% from 2013 to 2014.

1. Specify Security For Spousal Maintenance in the Divorce Order

Due to the high number of divorces, especially in the high net worth market, this has become somewhat of a specialist area. All assets require accurate appraisals by a professional appraiser. Tip: It is not necessarily a good idea to convert all assets to cash. For example, it may not be a seller's market in the property world and thus it may not be the best time to sell the family home. You may also get far less for other valued assets which have more of an emotional pull then financial value. It is better to decide who get's what.

5. A Thorough Evaluation of All Business Assets

This is often a lot trickier to investigate and receive funds from as the owner cannot dispose of assets without the consent of co-shareholders or without burdening his income-earning capacity. Your divorce attorney should ideally partner with an asset expert to thoroughly examine all assets. Be warned, looks can be deceiving and although the business owner may look flushed for cash, all money could possibly be tied up in debt and assets unbeknown to the spouse.

Drafting a divorce order can be an extremely complex matter both financially and emotionally. By enlisting the help of your own financial and legal advisor, you are able to make smart decisions about your future.
